Crimailed and the Website are owned by J&B Associates, a sole proprietorship and having registered address at Shop A/1, Jerome Villa, Azad Road, Vile Parle East, Mumbai, Maharashtra, India – 400057.

Users: If the person(s) and/or organisation(s) (“You” or “Your” or “User” or “Player”) access/browse/use the website www.crimailed.com, you are required to first carefully read as well as fully understand the Website related terms and conditions (“Terms of Use”), privacy policy (“Privacy Policy”), and any other policies (“Other Policies”) which are applicable when you view/access/use (collectively “use” or “using” or “usage”) the Website from any laptop, mobile/tablet or any other device which facilitates accessing the Website.
4. Eligibility: By accessing or using the Website, you represent and warrant that you are at least 18 years of age or older and are legally able to enter binding contracts. If you are under 18 years of age, you must be under the supervision of a parent or legal guardian to use the Website.

Disclaimer
Crimailed is a brand that produces tabletop, board, and physical games (the “Game” or "product") designed to enhance critical thinking, logical reasoning, and problem-solving skills through the process of identifying the killer(s) (the “Killer”) in the Game. The Game is exclusively intended for individuals aged eighteen (18) years and older.
1. Age Restriction and Parental Discretion: The Game is intended for sale solely to individuals aged eighteen (18) years and above. While the content may be suitable for users aged fourteen (14) and above, the participation of minors must be under the supervision of a responsible adult. It is the sole responsibility of the purchaser to ensure that the product is not accessed or used by individuals below the specified age without appropriate supervision. Users are strongly advised to exercise discretion before introducing the game to younger audiences. The creators and distributors disclaim any liability for unauthorized use or access of the game by minors. The creators of the Game shall not be liable for any emotional, psychological, or other harm caused to minors due to unauthorized access to the Game in violation of the stated age restrictions. By purchasing or accessing the Game, users represent and warrant that they are at least eighteen (18) years of age.
2. Fictional Nature: The Game is a purely fictional work created for entertainment purposes, and any resemblance to real-life events, incidents, persons (living or deceased), locations, organizations, entities, or religious practices is purely coincidental and unintentional. Crimailed expressly disclaims any intent to offend or insult the religious beliefs, sentiments, or cultural values of any individual or group. The Game is not intended to reflect or endorse any actual criminal activities or real-life scenarios. By purchasing or engaging with the Game, users acknowledge that they understand and accept its fictional nature, and agree to indemnify Crimailed against any claims arising from misinterpretation or alleged resemblance to real-life events, persons, organizations, or religious practices. Crimailed affirms its commitment to respecting all cultural and religious beliefs and will make reasonable efforts to avoid content that could be construed as offensive under applicable Indian laws, including Section 295A of the Indian Penal Code, 1860.
3. No Defamation Intent: Crimailed and the Game explicitly disclaim any intent to offend, libel, defame, malign, slander, hurt, be disrespectful, or cause harm to any individual(s), group(s), place(s), community(ies), religion(s), region(s), country(ies), or religious sentiment(s), belief system(s), or feelings of any person(s). The game does not reflect or endorse any political, religious, or cultural views. Scenarios, characters, and narratives are created without intention to stereotype, offend, or harm the dignity of any individual, group, or community. Any claims of offense arising from subjective interpretation shall not constitute grounds for liability.
4. Purpose and Intended Use: The primary purpose of Crimailed is to stimulate logical and scientific reasoning among its users. The Game is designed as an intellectual exercise to challenge players to think critically, interpret clues, and make deductions to identify the Killer in the fictional game scenario, aimed at promoting logical reasoning and critical thinking. Users agree to engage with the Game solely for lawful, educational, and recreational purposes and to use the Game in compliance with all applicable laws and regulations. No representation or warranty, express or implied, is made regarding the effectiveness or satisfaction derived from playing the game. The creators disclaim all liability for any dissatisfaction with the Game’s performance. The Game is provided on an "as-is" basis exclusively for entertainment purposes, and it does not constitute professional advice, and its benefits depend on individual engagement and interpretation. Any and all advice, opinion and/or suggestion is not legally binding, nor does it represent any real-life events or legal advice.
5. No Endorsement or Promotion of Violence: The Game, including but not limited to game scenarios, characters, storylines, events, and settings, does not reflect, encourage, or condone any form of real-world violence, crime, or disorderly conduct. Crimailed does not promote or intend to incite any disorder, unlawful activities, or public unrest amongst its Users. Crimailed expressly disclaims any endorsement or trivialization or promotion or glorification of violence, illegal activities, or unlawful behaviour in any form. The creators of Crimailed are all law-abiding citizens and have not created the Game to incite any disorder or lawlessness. The Game is a work of fiction designed solely for intellectual and recreational purposes, and should be approached as such. Players are encouraged to engage with the Game responsibly.
6. Emotional or Psychological Distress: Crimailed and the Game are based on murder mysteries designed to engage players in critical thinking, logical reasoning, and intellectual stimulation through fictional scenarios. Users acknowledge and agree to the following:
  1. The Game contains themes such as fictional crime, murder investigations, and mystery-solving, which may evoke unsettling emotions. These elements are inherent to the Game’s purpose and are presented in a manner consistent with its entertainment and educational goals.
  2. Crimailed disclaims liability for any emotional or psychological harm resulting from participation in the Game, except where such harm is a direct and natural consequence of a breach of Crimailed’s contractual obligations and is reasonably foreseeable, as per Section 73 of the Indian Contract Act, 1872.
  3. Users are advised to engage with the Game voluntarily and responsibly. If any content is found to be distressing, Users should discontinue participation and may contact customer support at customersupport@crimailed.com.
  4. Crimailed provides advance notice that the Game’s fictional content is not intended to offend, harm, or distress, and it disclaims liability for any indirect, incidental, or consequential harm arising from User interpretation or reaction.
  5. By purchasing or playing the Game, Users accept full responsibility for their engagement and agree to participate with an understanding of the Game’s nature and purpose.
7. Obscenity and Public Order: Crimailed is intended to provide intellectual stimulation and entertainment within the bounds of decency and legality. Players are encouraged to approach the content with maturity and understand its fictional nature. The creators and distributors disclaim any responsibility for interpretations that deviate from the intended context.
8. Unclear Rules or Gameplay Ambiguities: The rules and mechanics of the Game have been designed with the intent to provide a coherent and enjoyable gaming experience. However, interpretations of gameplay may vary among Users. In case of ambiguity or disputes arising from gameplay, the creators disclaim liability and encourage participants to resolve disagreements amicably.
Limitation of Liability
1. Use or Inability to Use: To the fullest extent permitted by law, Crimailed disclaims all liability for damages of any kind, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, injuries, or losses arising from the use or inability to use the products sold through the Website. This limitation applies regardless of the basis of the claim, including but not limited to negligence, breach of contract, or tort.
2. Misuse or Misinterpretation or Unintended Consequences: Crimailed and the Game shall not be liable for any direct, indirect, incidental, or consequential damages arising from the misinterpretation, misuse, or unintended consequences arising from the use of the Website or the Game, including but not limited to psychological harm, offense, or dissatisfaction.
3. Third-Party Services: Crimailed shall not be liable for any indirect, incidental, or consequential damages arising from any failure or issues caused by third-party services present on the website while using the Website or the Game, including but not limited to lost profits, or reputational damage.
4. Intended Use: You acknowledge and agree that Crimailed and its products such as the Game are for entertainment and intellectual stimulation purposes, and any deviation from its intended use is at the sole risk of the user. Users assume full responsibility for their participation and agree to engage with the Game in a lawful and responsible manner.
5. Maximum Liability: You acknowledge and agree that you use the products at your own risk, and in no event shall our total liability exceed the amount paid by you while purchasing the specific product in question.
Limitation of Warranty:
1. “As Is” Basis: The Website, its services, the products sold on the Website, the Game, and all included content are provided on an "as is" basis without any warranty, whether express or implied. To the fullest extent permitted by applicable law, Crimailed explicitly disclaims all warranties and conditions of merchantability, effectiveness, suitability, or fitness for a particular purpose, and non-infringement, as well as any warranties arising from the course of dealing or usage of trade.
2. Interruptions, Errors, or Viruses: Crimailed does not warrant that the functions contained in the Game and the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the server that makes it available is free of viruses or other harmful components. You (and not Crimailed) assume the entire cost of all necessary servicing, repair, or correction.
3. Correctness, Accuracy, or Reliability: Crimailed does not warrant or make any representations regarding the use or the results of the use of the materials on the Website in terms of their correctness, accuracy, reliability, or otherwise.
4. Non-delineated Warranties: All warranties, representations, and obligations not explicitly delineated in the Terms of Use, whether expressly stated or implied by law, are hereby disclaimed to the fullest extent permitted by law.
Indemnity
1. Indemnity: By using Crimailed and the Game and by using Crimailed’s products, users agree to indemnify, defend, and hold harmless Crimailed, the creators, distributors, affiliates, and agents from any and all claims, losses, damages, liabilities, costs, or legal expenses arising out of:
  1. Your use or misuse of the Website, Game, or products;
  2. Breach of these Terms of Use or violation of any applicable laws;
  3. Unauthorized or unlawful use of the Game or Website;
  4. Any claims related to user behaviour that may infringe on third-party rights (such as defamation, intellectual property infringement, etc.).
2. Limitation of Liability: This indemnity does not apply in the event of Crimailed’s gross negligence, willful misconduct, or failure to comply with applicable laws and regulations.
3. Acknowledgment of Indemnity: By continuing to use the Game and/or Crimailed’s services, users acknowledge that they have read, understood, and agreed to this indemnity clause. This indemnity is an essential part of the Terms of Use, and users expressly consent to its application during checkout by checking the "I agree" box.
Payment and Billing
1. Payment: The amount to be paid by You to purchase any of the Crimailed’s product(s) will be displayed at the checkout page.
2. Payment Processing: All payments for products purchased on the Site are processed securely through Razorpay, a third-party payment gateway. By purchasing from our website, you acknowledge and agree that your payment details (such as credit card information or other payment methods) will be securely processed by Razorpay, and we do not store or process your payment information ourselves. You agree to comply with Razorpay’s Terms of Service and Privacy Policy.
3. Security of Payment Information: We use Razorpay's secure payment gateway to handle all transactions. Razorpay uses encryption technologies to ensure the safety and confidentiality of your payment information. While we take reasonable measures to protect your payment information, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures. You acknowledge and agree to this limitation.
4. Refunds and Cancellations: Refunds for purchases made through Razorpay will be subject to the refund policy set forth by us. If you are eligible for a refund, we will process it through Razorpay, and it will be issued according to Razorpay's policies. Razorpay may charge processing fees for certain refunds or chargebacks, which are your responsibility.
5. Payment Disputes: In the event of a dispute related to payments or charges, you should first attempt to resolve the matter directly with us. If necessary, we may refer the dispute to Razorpay for investigation and resolution. If a transaction is disputed or reversed, you agree to abide by Razorpay's procedures for dispute resolution. We are not liable for any delays or issues caused by the payment gateway or third-party payment services.
6. Currency and Transaction Fees: All payments for products on this website are processed in Indian Rupees. You are responsible for any applicable currency conversion fees or transaction charges imposed by Razorpay or your financial institution or bank. Razorpay may charge processing fees for certain transactions, which are typically reflected in the total cost at the time of payment.
7. Compliance with Local Laws and Regulations: You agree that all payments are subject to the applicable laws and regulations of the country in which the payment is made. You agree to comply with any regulations or restrictions imposed by Razorpay and other financial institutions involved in processing your payment.
8. Liability Disclaimer: We make no representation or warranty regarding the services provided by Razorpay or the payment gateway system. Crimailed shall not be liable for any payment processing failures, including transaction errors or delays. We are not responsible for any issues related to payment failures, unauthorized transactions, incorrect billing, or technical issues experienced during payment processing. Any issues related to the payment gateway should be addressed directly to Razorpay or your financial institution.
9. Razorpay’s Terms and Privacy Policy: By using Razorpay to make payments on this website, you acknowledge that you have read, understood, and agreed to Razorpay's Terms of Service and Privacy Policy.
Refund Policy
1. Consumer Protection Rights: The products available for purchase on the Website are subject to the provisions of the Consumer Protection Act, 2019, as well as any applicable regulations concerning refunds, replacements, and warranties. Crimailed commits to honoring your statutory consumer rights, including the right to a refund for defective or damaged goods.
2. Communication: All refund, cancellation, and replacement requests should be submitted via the Website or by contacting customersupport@crimailed.com. We aim to resolve all issues promptly and fairly.
3. Consumable Nature of the Game: You acknowledge and agree that the Game is a one-time use consumable product. Once the Game has been played or accessed, it is considered consumed and, as such, is non-returnable and non-refundable. You are encouraged to review all available information and ensure that the product meets your expectations before purchasing.
4. Prior Shipment Refund Policy: If you wish to cancel an order, you may do so prior to shipment. You are eligible for a full refund if requested before shipment of the order.
5. Post Shipment but Before Delivery Refund Policy: If cancellation is requested after shipment but before delivery, a partial refund will be granted. The shipping charges incurred by Crimailed will be deducted from the refund amount. This partial refund is contingent upon the customer refusing delivery. If the product is already in transit, customers are advised to refuse delivery upon arrival to facilitate the partial refund process.
6. Post Delivery Refund Policy:
  1. Due to consumable nature of the game, if refund is requested after delivery, no refund is granted. You acknowledge that the right to a refund does not extend once the product has been delivered.
  2. Since the Game is a one-time consumable product, no refund will be provided once the product has been used.
  3. If the product is found damaged upon delivery or if the packaging is opened or tampered, you must report the issue within 12 hours of delivery to be eligible for a replacement. Claims made after this 12 hour period will not be considered.
  4. If the defect is reported within the 12-hour window, we will proceed with a replacement of the product, subject to the following conditions:
    1. The product must be returned in its original condition and packaging.
    2. Replacement requests must include evidence of the damage (e.g., photographs or videos), which are acceptable to Crimailed.
    3. The replacement will be processed within 5-7 business days from the receipt of the defective product.
    4. The replacement shipping will be done within 10 business days after the receipt of the damaged product(s).
7. Missing Component(s): If the order contains any missing component(s), please contact the email address customersupport@crimailed.com. In such a case, the missing component(s) will be delivered to you. You acknowledge and agree that Crimailed is not liable to refund your order in the case of missing component(s).
8. Damaged Delivery: If the product is found damaged upon delivery, you may request a replacement. Replacement requests must be made within 12 hours of delivery. All replacement requests must be accompanied by evidence of the damage or issue. Crimailed will not process any replacement requests for damages if evidence is not provided within the specified time. All damaged products must be returned in their original packaging to process the replacement. You acknowledge and agree that Crimailed is not liable to refund your order in the case of damaged delivery. Crimailed reserves the right to assess whether a product is defective on a case-by-case basis, considering the nature of the defect and the circumstances of the claim. If Crimailed determines the product is defective, a replacement will be issued.
9. Request Rejections: No refund or replacement requests will be processed after 12 hours from delivery, except in cases where a product is defective or does not meet the specifications stated at the time of purchase. Refunds or replacements will not be processed for products that are not damaged or faulty. You acknowledge and agree that we have the right to refuse refunds/replacements in the case of insubstantial/tampered/fake evidences. You agree to cooperate with the team to furnish required evidences, details, and communications to process the refund/replacement requests. You acknowledge and agree to furnish the required evidences and details within 3 days of our reply to you.
10. Refund/Replacement Timelines:
  1. All requests for refunds or replacements will receive a response within 7-10 business days of submission.
  2. Once the necessary details and evidence are received, approved requests will be processed within 7-10 business days.
  3. For processed return requests, refunds will be credited to your bank account within 5-7 business days after the approval of the refund.
  4. For replacement requests, products will be shipped within 15 business days after approval.
11. Return Processing via Razorpay: Returns will be processed through Razorpay, in accordance with Razorpay’s policies. Transaction fees may apply, and Razorpay may charge a processing fee for refunds or chargebacks.
12. Grievance Redressal Mechanism: In the event that you are dissatisfied with our resolution of a refund or replacement request, you may escalate the matter to our Grievance Redressal Officer at info@crimailed.com. We will acknowledge your complaint within 7 business days and resolve it within 21 business days. If a satisfactory resolution is not achieved, you may refer the matter to the relevant consumer forum under the Consumer Protection Act, 2019.
Shipping and Delivery Policy
1. Shipping Providers: The order will be sent to you through the third-party delivery providers.
2. Shipping Costs: The costs associated with shipping and delivery will be informed while making the payment at the checkout.
3. Shipping Time: The order will be dispatched within 7-10 business days of confirmation of the payment.
4. Delivery Time: The order will be delivered within 7-10 business days of dispatch.
Intellectual Property
1. Intellectual Property Rights: Intellectual Property (“IP”) Rights refer to all existing or future intellectual property rights, encompassing trademarks, copyright, moral rights, database rights, know-how, and any other rights related to intellectual and proprietary information. This includes all alterations, renewals, rights to apply for renewals, and extensions of the aforementioned rights, as governed by the laws of any India.
2. Trademark: Crimailed™ is a registered trademark of J&B Associates. Any unauthorized use, reproduction, or imitation of this trademark is prohibited by law.
3. Website Content: The content on the Website, including without limitation, the text, software, images, scripts, graphics, photos, sounds, music, videos, and interactive features (the "Content") and the trademarks, service marks, and logos contained therein (the “Marks”), are owned by, or licensed to J&B Associates, subject to copyright and other IP Rights under the Indian laws.
4. Website Content Restrictions: Unless stipulated otherwise in the applicable Content, and contingent upon Your adherence to the obligations outlined in these Terms of Use, You are authorized to display, copy, print the Content present on this website, with the conditions that:
  1. You do not edit the Content, and
  2. Your use is restricted to informational and non-commercial purposes only, and
  3. Any copies made of the Content must include all copyright or other attribution information associated with the Content.
5. The Game Content: All content, elements, and intellectual property within the Game, including but not limited to scenarios, storylines, characters, designs, text, images, gameplay rules, and branding are the exclusive IP of J&B Associates and are protected under Indian copyright laws.
6. The Game Copyright: Unauthorized reproduction, distribution, adaptation, commercial exploitation, or use of any part of the Game’s content is strictly prohibited and subject to legal action under applicable laws, including the Copyright Act, 1957.
7. The Game Purchase: Purchase of the Game grants You a royalty-free, non-exclusive, non-transferable, and non-sublicensable license to use the Game in question. You acknowledge and agree that:
  1. The exclusive ownership of any IP pertaining to the Game belongs to J&B Associates or its licensors, where applicable. The purchase of the Game does not transfer ownership of it/them to you.
  2. All current and future rights and title to the Game, including the authority to grant access and usage rights, are vested in J&B Associates and, where applicable, its licensors.
  3. The use of the Game is limited to Your internal purposes, unless otherwise agreed in writing with J&B Associates.
8. The Game Restrictions: You acknowledge and agree that You may not, unless expressly permitted:
  1. Including but not limited to sell, sublicense, distribute, display, copy, disassemble, decompile, reverse engineer, translate, transfer, or otherwise make any part or any content of the Game available to others;
  2. Use the Game or its content to create any derivative works or products that could be considered competitive products;
  3. Allow third parties to access, benefit from, or use the products or its content;
9. Revocation: Your rights granted under this Terms of Use may be revoked if You fail to adhere to any of its terms. Upon receiving a revocation notice, You and any individuals to whom You have granted access to the Website or the Game must promptly:
  1. Discontinue the use or access of the Website, its services, the products, the Game and its content; and
  2. Eradicate all copies of the products, their contents, and any information or derivative works generated or obtained by You because of this Terms of Use.
10. Indemnity: You acknowledge and agree to indemnify Crimailed, its members, employees, officers, and licensors against any and all liability arising from Your or any third party's unauthorized use of the Website, the its products, the Game, or its contents provided to You, as well as any use by You or any third party of derivative works created by You.
11. Third-Party Indemnity: You are obligated to indemnify Crimailed against all costs and expenses, including reasonable legal fees, arising from any claims asserting that any derivative work created by You based on any Product infringes on the Intellectual Property Rights of a third party. You agree to collaborate with Crimailed in the defense of such claims at Your own expense.
12. IP Claims: Any claims of intellectual property infringement against J&B Associates must be substantiated with clear evidence of prior rights to similar material and should be emailed to customersupport@crimailed.com.
Reviews, Comments, and User-Generated Content
1. User-Generated Content: By submitting any content to the Site, including but not limited to reviews, comments, ratings, suggestions, or any other form of feedback (collectively referred to as "User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully transferable right to use, modify, adapt, publish, translate, distribute, and display such content in any media, worldwide, without compensation or notice to you.
2. Content Ownership: You affirm that you are the sole owner of the User Content you submit, or that you have all necessary rights and permissions to submit such content. You retain ownership of the User Content, but by submitting it to us, you grant us the license mentioned above.

User Conduct
1. System Requirements: It is Your responsibility to ensure the access to the Website and to possess and maintain licenses for any necessary software required to access the Website.
2. Unlawful and Harmful Activities: You agree not to use the Website for any unlawful, fraudulent, harmful, or malicious activities. This includes, but is not limited to:
  1. Share any password, username, or any other access information that could be used to gain unauthorized access or utilization of the Website and its products.
  2. Violating any local, state, national, or international laws or regulations.
  3. Transmitting any material that is abusive, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  4. Posting abusive, offensive, or threatening comments or reviews.
  5. Transmitting any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.
  6. Posting off-topic information or using Crimailed as a medium for advertising Your product, business, or site(s), etc.
  7. Engaging in fraudulent transactions or activities that are detrimental to other users or the platform.
